Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and GameDevil AI concerning your access to and use of our website and services. By accessing or using our services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

Intellectual Property Rights

The content on our website and services, including without limitation text, graphics, logos, icons, images, audio and video clips, and software, is owned by or licensed to GameDevil AI and is subject to copyright and other intellectual property rights under United States and foreign laws and international conventions.

Subject to these Terms of Service, GameDevil AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use our services solely for your personal, non-commercial purposes.

User Content

Our services may allow you to create, upload, post, send, receive, store, and share content. You retain any rights that you may have in the content that you post to the services.

By creating, posting, or sharing content on or through our services, you grant GameDevil AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, copy, modify, create derivative works from, distribute, publicly display, and perform your content in connection with operating and providing our services.

You represent and warrant that: (i) you own the content posted by you on or through our services or otherwise have the right to grant the licenses set forth in this section, and (ii) the posting of your content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

User Accounts

When you create an account with us, you must provide accurate, complete, and up-to-date information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access our services and for any activities or actions under your password. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions.

Acceptable Use

You agree not to use our services:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation
• To impersonate or attempt to impersonate GameDevil AI, a GameDevil AI employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the service, or which may harm GameDevil AI or users of the service

Subscription and Payments

Some of our services may be subject to payments now or in the future. If you elect to use paid features of our services, you agree to the pricing and payment terms, as we may update them from time to time. GameDevil AI may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion.

You may cancel your subscription at any time. If you cancel, you will not be charged for any additional terms; however, you will not receive a refund for the current subscription term.

Disclaimer of Warranties

YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GAMEDEVIL AI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

IN NO EVENT SHALL GAMEDEVIL AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

Term and Termination

The Terms will continue to apply until terminated by either you or GameDevil AI. GameDevil AI may, in its sole discretion, terminate or suspend your access to all or part of our services, with or without notice and with or without cause.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
